Revolution Viewing Ltd Terms and Conditions
1 Photography / Production / Post Production / Duplication / Web Design / Design / Video
All orders placed with Revolution Viewing Ltd (RV), by and for the account of the Customer, are subject to the following terms and conditions.
1.1 Formal quotations. Any formal quotation issued by Revolution Viewing Ltd. Shall remain valid and correct (subject to the specifications remaining the same) for up to 28days from date of issue. Following this time, you must contact Revolution Viewing Ltd to confirm whether a new quotation may be required.
2 Cancellation & re-scheduling Notification of a cancellation or project re-schedule must be sent to admin@revolutionviewing.com. There will be no cancellation or rescheduling fee, provided we receive a cancellation or reschedule email with a minimum of 3 working days (72 hours) notice. The notice period required is worked back from the time by which the Revolution Viewing employee is due on site. For example, if on-site work is due to commence at 10am on a Tuesday, Revolution Viewing Ltd would require notification before 10am on the previous Thursday to ensure no cancellation or rescheduling fee is incurred.
2.1 If cancellation or rescheduling notice of 24 to 72 hours is given, this will incur a 50% cancellation fee. Cancellations or reschedules with less than 24 hours prior to scheduled arrival will incur the full (100%) of the quoted price for the project.
2.1.1 Delay The time of the RV photographer's arrival on-site will be confirmed prior to a project commencing. The RV Head Office and photographer on-site will do everything possible to make contact with the client when arriving on-site. After 1 hour of waiting, if the client/contact does not arrive this will be treated as a cancellation. The RV photographer will leave site and the client will be charged in full for the project.
2.2 Weather conditions. The weather may influence the scheduling of a shoot. Should a shoot require outdoor virtual tours and/or photography, it is the client's responsibility to monitor the weather forecast and give Revolution Viewing the appropriate cancellation notice in accordance with the terms outlined above (sect. 2 / 2.1). We recommend using the BBC 5 day weather forecast. If fair weather is absolutely essential for a shoot then it is the client's responsibility to monitor the weather forecast and make a booking request based upon the client's findings/forecast. Due to weather dependant shoots often requiring short notice bookings, Revolution Viewing cannot guarantee it will be able to accommodate a client's request.
2.3 Date reservation. When a client requests that a day, or several days are reserved for a potential booking the Revolution Viewing standard policy is to note the dates on the company diary system. Such reservations will be held until confirmation of the date(s) or until 10 working days before the date(s). When there are less than 10 working days before the reserved dates then these days will then no longer be reserved for that client unless a booking confirmation and 50% advanced payment is made.
Should a 2nd client wish to book out a date that is reserved by the 1st client, Revolution Viewing will inform the 1st client that they have 24 hours to confirm whether they wish to book this date. At this point the 1st client must make the 50% advance payment to secure the booking of this date.
3 Terms of payment
Revolution Viewing Ltd standard payment terms require 50% payment prior to a project commencing. This payment must have cleared and entered the Revolution Viewing bank account 5 working days prior to the scheduled time the Revolution Viewing Ltd employee is due to arrive on-site.
3.1 In exceptional circumstances Revolution Viewing Ltd may accept a screen print of the BACS transfer confirmation or remittance confirmation from a client's on-line banking facility.
3.2 On occasion, alternative payment terms may be negotiated with a director of Revolution Viewing Ltd. Evidence of such negotiations must be supported in writing or via email.
3.3On completion of a project the client will be invoiced for the final amount. This invoice must be paid in full within 30 days of the date of the invoice. Interest charges of 1.5% per month shall accrue on accounts outstanding more than 30 days. These are the Revolution Viewing Ltd terms of payment, if any element of these terms are not acceptable then please ensure all comments are emailed to admin@revolutionviewing.com prior to a project commencing. By agreeing to commence in business the client is agreeing to the above conditions of payment.
3.4 In the event of non payment, 52 days after the invoice date, Revolution Viewing Ltd retains ownership of all materials produced and reserves the right to reposes materials (physical or virtual). Payments to be made to Revolution Viewing Ltd. See BACS details on the previous page.
3.5 Flights, vehicle rental and accommodation must be paid for in full by the client either direct to the supplier (airline/travel company etc.) or to Revolution Viewing, at least 5 working days prior to a shoot commencing.
3.6 Additional expenses that have not been identified prior to the project commencing; such as congestion charge, parking, accommodation etc. will be charged on final invoice if not included in the initial quote.
3.7 Revolution Viewing Ltd receives prompt payment of invoices by the vast amount of it's clients. However, there have been a small number of clients (an absolute minority) that have caused serious concern through extremely late payment of invoices and in some cases no payment due to bankruptcy. Revolution Viewing is no longer willing to spend considerable time and money on chasing payment from this minority of late paying organisations. In response, Revolution Viewing Ltd has put a strict procedure in place to ensure no more time and money is wasted chasing payment than is absolutely necessary. All clients who take longer that 60 days to process payment will be instructed to pay 100% pre project on future bookings
Please note. The debtors procedure will only apply to clients that do not pay invoices within the specified 30 days of a Revolution Viewing invoice being received.

4 General Liability - The Customer shall indemnify and hold Revolution Viewing Ltd harmless from all suits, claims, demands and other liabilities (including reasonable council fees) arising out of, or in connection with, any goods or services furnished by Revolution Viewing Ltd. Revolution Viewing Ltd shall not be liable for any loss of any kind due to delays or failure in performance by it or any other agency.
4.1 Force Majeure – As an extension to the above, Revolution Viewing Ltd reserves the right to be excused from liability in the occurrence of unforeseen events beyond the control of the company during all stages of project capture and/or production (including delays to any element of a project due to occurrences beyond the control of Revolution Viewing.) Such events include (but are not limited to); Acts of God, war, failure of 3rd parties to perform obligations to Revolution Viewing Ltd.
5 Technical - Hosting – A client's virtual tour will be hosted using the standard Revolution Viewing Ltd template with either floor plans (if supplied by client) or slide out navigation. Revolution Viewing Ltd will add a client's logo and colours to the template. These shall be copied from the client's website. Should the client require any changes to the standard template (please request an example if unsure) there will be an additional charge.
5.1 Hosting - When hosting or supplying virtual tour files, the standard virtual tour window size will be 780 x 330 pixels for Classic and 960 x 410 for Premier Virtual Tours. All virtual tours will be displayed using the Revolution Viewing Flash viewer. If the client requires anything other than the standard viewer this will incur an additional charge.
5.1.2 Hosting Charges – Hosting (up to 1GB of bandwidth per month) is free for 5 years from the date the virtual tour link was sent to the client. Thereafter the client will be requested to pay £10 per year if the virtual tour is to remain live. 1 GB equates to approximately 2000 visitors per month (depending on number of movies the individual views per visit). The majority of Revolution Viewing clients will not use more than 1GB. 1GB to 5GB of bandwidth usage per month will be charged at £10 per month, payment in advance for 6 month minimum period is required. 5GB to 10GB is charged at £20 per month, 10GB+ is POA.
N.B. Revolution Viewing Ltd reserves the right to amend a hosted virtual tour web address at any time. In the event of web address changes for a virtual tour, the client will be notified by e-mail and may need to amend the any links to your virtual tour page. Revolution Viewing Ltd supply no remuneration for costs incurred in changing this link.
5.2 Client Hosting – Should a client wish for either their own web team to host the virtual tours or for a third party company to host the virtual tours, RV highly recommends the client requests test files in the early stages of a project. To ensure there is minimum delay in a client project going live, it is recommended that full testing takes place prior to RV attending the shoot at a client's premises. RV will send the client generic files to help test their system. If the client wishes to integrate the virtual tours within a content management system, a database, or anything else that could be deemed 'none standard', testing prior to receiving the completed files from RV is highly recommended in order to avoid possible post production delays.
Should a client's web team or 3rd party web company need technical assistance and/or advice in order to integrate virtual tours within their system, there will be an hourly charge to assist, with a minimum charge of £50.
RV should be notified of any alterations to code or any changes to the virtual tour template, interface or navigation prior to post production work commencing. Typically, post-production work will commence as soon as a shoot has been completed or as soon as RV is in receipt of all information and items required to complete the virtual tour.
Where virtual tours are hosted on a client's website and carry the Revolution Viewing branding, RV reserves the right to request amendments to incorrectly integrated files, deemed to have a detrimental effect on the perceived reputation of the company and our brand, service and solutions.
5.3 Models – Using models/people in a virtual tour will generally increase the amount of time a shoot will take to complete on-site and the post production studio time is generally double. For this reason, virtual tours with 1 or more people in shot may require adjustments that will incur additional project costs.
5.3.1 Ghosting – This is the virtual tour term used for when people are moving when a virtual tour is shot. The effect of 'ghosting' leaves people 'cut' in half or looking very faint (like a ghost). RV advise that clients ensure ALL subjects remain perfectly still whilst the RV photographer is taking his shots. When shooting in very crowded environments or outside with moving traffic, ghosting is sometimes impossible to avoid. Clients should be aware that if they wish for 'ghosts' to be removed, there will be a charge. See “airbrushing” in the quote template. Please note that for shots with lots of ghosting, the price may have to be increased.
5.4 Client web developers - Occasionally Revolution Viewing Ltd may supply a client's web-developer with code or technical information. Help in addition to supplying code such as, fault finding, help with code or scripting, de-bugging etc. will be charged at the Revolution Viewing standard hourly rate, Minimum charge £50.
5.5 Photography – A standard photography package includes up to a maximum of 24 photographs. The Revolution Viewing photographer may feel that fewer shots will cover all the available angles and compositions of a property/project/product/facility. A wide angled photograph will be taken of each location requested (as standard). The package also includes artistic photographic shots. The composition of these shots will be at the discretion of the Revolution Viewing Ltd photographer, unless a shot list is specified by the client via email 48 hours prior to the the project commencing. Should the client insist upon the full 24 shots being taken, the client must submit a shot description document via email 2 working days (48 hours) prior to the Revolution Viewing photographer's on-site appointment. This document must clearly outline each of the 24 shots required. The client must state if RAW files for stills are required. If the intended image output is to be larger than 5000x2500 @180 DPI the client must also state this prior to a shoot.
When booked with a virtual tour package, the package discount assumes that photographs will be captured for the same rooms / areas as the virtual tour movies. Should the client require capture of images in further rooms / areas, then an additional charge will be made (based upon the volume of the additional requirements). Should the client require a 'contact sheet', this will be chargeable at a rate of £75. When supplying a package of 24 images, a contact sheet of approximately 60 images will be supplied for selection purposes. This must be requested via e-mail 48 hours prior to the shoot commencing to make necessary arrangements..
5.6 Supplying images & content – Revolution Viewing are often asked to provide images for a client. There is a standard pricing list for retrieving images from the Revolution Viewing archive and dispatching to a client.
5.7 iPhone 360 – Quoted iPhone 360 price is for conversion of a 6 movie Premier or Classic package. Single movie conversion is priced at £75, additional movies (above and beyond 6 movies) are priced at £20 per movie. iPhone tours are a stripped down version of our standard virtual tour packages, all functions / options (full screen, information hotspots, floor plan navigation, etc) may not be possible in iPhone format.
6 On-site Time allowance
Virtual tours - Our photographer will take a maximum of 30 minutes per room/location within a building. A typical 6 movie shoot will be complete within 3 hours. Should you require our photographer for longer than the average of 30 minutes per movie then we will have to charge a standard rate of £50 per hour thereafter. A shoot that over-runs by 30 minutes will incur the same £50 charge as a shoot that overruns by 1 hour.
6.1 Overrun Notice: If, during the planning stages a client feels it is likely a shoot is going to take more than an average of 30 minutes per movie/location then the client must notify Revolution Viewing Ltd prior to the shoot commencing. Should the client fail to notify Revolution Viewing Ltd of a shoot overrun until the day of the shoot, the client will be charged £50 per hour that the shoot has overrun by. Note: Shoot Overruns are most commonly due to poor scheduling by the client and lack of preparation. Efficient pre-scheduling and preparation will save the client money.
6.2 Important note: If a client's project is charged at £1,600 or more (excluding VAT & excluding travel expenses), this warrants a full day, 8 hour (9am until 5pm with a break) shoot. Sometimes Revolution Viewing Ltd will also be on-site with other duties such as taking professional photography. On a multi-disciplined shoot the rule of 1 hour per £200 charged applies. Eg. A project charged at £1,200 (excluding VAT & excluding travel expenses) warrants 6 hours on-site with a client. Often the on-site aspect of a project will exceed £1,600 and yet take less than 1 day. In general the post production element of our projects (carried out in our studio) will take a considerable amount of time. The on-site & post-production elements of a project are often completely disproportionate in terms of duration.
6.3 Hours of work – Should the timings of a shoot fall outside the hours of mon-fri, 9am to 5pm the client must notify Revolution Viewing prior to a project commencing. Without notification there may be an additional charge on top of the standard surcharge. If a client wishes for a shoot to take place outside the normal working hours of 9am to 5pm or wishes to shoot on a Bank Holiday, a Saturday or a Sunday, there will be an additional surcharge. This surcharge does not cover payment for accommodation, transport or any other expense. All such expenses will be charged in addition to the surcharge.
6.4 Unless otherwise stated, each project quotation assumes any on-site aspect of project can be completed within a single (eight hour) day, between the hours of 9am and 5pm and not split between 2 or more days.
6.5 Early project starts - Should a client require a shoot to begin at a time that requires the Revolution Viewing photographer to leave Leeds before 7am it is deemed reasonable for Revolution Viewing to request that the client provides adequate accommodation for the night before the shoot to ensure the Revolution Viewing photographer is fresh and that a prompt start can be made.
6.6 Additional Movies on-site On occasion, the capture of areas in addition to those scheduled may be requested by the client when on-site. Where possible the Revolution Viewing photographer will try to accommodate such requests. Additional movies will not be automatically processed. Should the client wish to view the additional movies there will be a standard preview charge (see page 1) . Should the client be happy to proceed with the processing of the additional movies then the standard additional movie charges will apply.
7 Project duration - Revolution Viewing must be protected against a client's delayed feedback, which can ultimately postpone the completion date of a project. 2 months after the initial email from a client expressing intent to begin a project, or 2 months after a Revolution Viewing representative has spent his first day on-site for a client, the full amount for a project will be invoiced. Full payment will be required in line with our standard payment terms.
7.2 Turnaround times - Turnaround time allocated to a project does not begin until RV is in receipt of ALL information from the client that is required to complete the project. Typical examples of information/items that are submitted late and therefore delay the completion of projects are; floor plans, text for information spots & client logo.
For projects of a value of £1,500 or less, the standard turn around time is 10 working days from the date of capture (ie – The day after the Revolution Viewing photographer leaves site is the first day of the turn around time allocated to that project). Projects to the value of £1,501 to £3,500 will have a standard turn around time of 15 working days. Projects valued at £3,501 or more will have a standard turn around time of 20 working days, unless otherwise specified by a Revolution Viewing project manager. Please specifically state any deadlines you may have and ensure you receive a confirmation email from your RV project manager regarding the agreed completion date of your virtual tour.
7.3 Express turnaround. There will be a nominal charge for completing a project faster than the standard turn around time stated above (section 7.2). Each day less than the standard completion time will be charged at 2% of the completed project total. For example, if a client must have a £1000 project turned around in 6 working days, the client will need to pay an additional 2% (£20) for each of the 4 days (10 day standard turnaround, minus the 6 days required turnaround = 4 days less than standard turnaround time). In this instance, the express turnaround charge would be £80.
7.4 Delayed project completion. Revolution Viewing projects are often a single element that is part of a whole project (ie a component of a new website or website update). On occasion Revolution Viewing will require information from the client or a third party in order to fully complete a project (2 example scenarios (a) The latest branding for a template is not completed by a third party but is required to complete a project (b) completing a project may involve re-sizing a virtual tour window when the client website is completed at a later date). Regardless of the item Revolution Viewing are waiting for, once at the stage where Revolution Viewing have completed as much work as possible an invoice will be issued regardless of whether there are outstanding elements that must be changed. Revolution Viewing will expect payment in line with the usual terms and in good faith, RV will complete the remainder of the project when the necessary elements and/or information is supplied.
8 Disclaimer
Revolution Viewing Ltd apply past experience and knowledge to all projects. Lighting levels, exposures, locations, angles and all factors of image composition, capture and production are at the photographer's discretion, unless explicitly stated in writing or via email by the Client prior to a project commencing. Revolution Viewing will use Photoshop re-touching skills to 'patch in' the ground beneath the tripod's location for Premier standard movies. However, please be aware that with certain floor coverings such as tiling, patterned carpet and wood/laminate, satisfactory re-touching may not be achievable. In such instances, Revolution Viewing Ltd will apply a branded 'mirror ball' to the 'nadir' (bottom) of a virtual tour. This addition is an equally time consuming process, so the original charges for a premier package will still apply.
9 Copyright
Copyright law, as quoted below (9.2), suggests that reproduction rights remain the property of Revolution Viewing Ltd. However, strictly upon request and on a 'project by project' basis, Revolution Viewing Ltd may be prepared to review it's position regarding copyright law for certain projects. Under special circumstances Revolution Viewing Ltd may be prepared to licence materials for client use. In such circumstances it is the client's responsibility to seek email confirmation of such a licence agreement.
Revolution Viewing Ltd reserves the right to be credited for work wherever it may be displayed. See note 9.1 below.
9.1 Client web pages or media containing Revolution Viewing images must state “Copyright © (year) Revolution Viewing Ltd” either within the supplied images or beside aforementioned images, minimum specification; Arial, font size 9 (white colour preferable – dependant on background). Any unauthorised production may incur legal proceeding to recover loss of earnings. Stated in accordance with Copyright, Design and Patents Act 1988:
9.2 The Law gives creators rights to control the ways in which their material may be used. The rights cover: broadcast and public performance, copying, adapting, issuing, rental and lending copies to the public. Types of work protected: Photography, architecture, technical drawings / diagrams, logos. Copyright is an automatic right and arises whenever an individual or company creates a work. To qualify, a work should be regarded as original, and exhibits a degree of labour, skill or judgement. Normally the individual or collective who authored the work will exclusively own the work. Freelance or Commissioned work will usually belong to the author of the work, unless there is an agreement to the contrary, (i.e. In a contract of service). Copyright notices: The notice should be obvious and legible, and if applicable, (e.g. Websites) the notice should appear on every page. Mark any copies of your work with a notice, on the body of the work. The notice should take the form of: The actual term “copyright”. The copyright symbol “©”. The year. The name of the owner (individual, collective or organisation).

9.3 Revolution Viewing Ltd insist on having our copyright logo and branding present on all multimedia work we supply. This is primarily to ensure no third party is able to have our work accredited to them and to preserve our Intellectual property rights.
On the rare occasions that a client feels it is essential to have all our company branding removed, this will incur a 50% increase to the total ex vat project cost. By agreeing to this contract, the client acknowledges that the re-branding / absence of Revolution Viewing's copyright logo / brand is only for aesthetic purposes and Revolution Viewing Ltd are still the true authors of the work.
10 Value Added Tax
All rates are subject to Value Added Tax unless a valid Tax Exemption Certificate is presented to Revolution Viewing Ltd for it's records.
11 Shipping (as applicable)
All materials will be shipped to and from Revolution Viewing Ltd at the Client's risk and expense.
12 Customer Supplied Materials (as applicable)
In the event of a client supplying old and / or imperfect images or materials to be used by Revolution Viewing Ltd in production of goods or services, Revolution Viewing will not be responsible for the quality resulting from the use of such materials.
13 Warranty
As the intrinsic value of the Customer's final product clearly bears no relationship to the charges for photography, post production, duplication and other services, Revolution Viewing Ltd assumes no responsibility for the loss or damage from any cause whatsoever, including loss resulting from negligence of Revolution Viewing Ltd employees. Should a product be found to be defective, Revolution Viewing Ltd will make every effort to repair or replace such defects assuming physical materials are returned (as applicable) and written notification is given within 10 days of receipt of physical or virtual goods. Customers waive any claim for adjustment in billing which is not timely and presented according to the provisions of this paragraph.
